This is the official privacy policy of the STUDIONOW website and services (“Privacy Policy”). This privacy policy is incorporated with and subject to the Terms of Use Agreement (“The Agreement”) STUDIONOW has with you regarding your use of the STUDIONOW website and service. The Agreement, including, without limitation, this Privacy Policy, is legally binding on all users of the STUDIONOW website and service. Any terms that are not defined in this Privacy Policy shall have the meaning given in the Agreement. This Privacy Policy governs only the Personal Information (as defined in its Terms of Use) collected by STUDIONOW as a result of your use of or registration with STUDIONOW. This Privacy Policy does not cover any information collected in any other manner, for any other purpose or by any other web site or enterprise. Keeping the Personal Information you share with us on the STUDIONOW website secure and ensuring your understanding of how STUDIONOW collects, uses, discloses and maintains your Personal Information is important to us. STUDIONOW maintains reasonable standards of security and confidentiality. However, for most Internet sites, it is possible that third parties may unlawfully intercept or access transmissions or private communications over an unsecured transmission. Send your requests via postal mail. Mail must be labeled “Your California Privacy Rights” on the envelope or post card. The label “Your California Privacy Rights” must be included on the actual request. Include your name, street address, city, state, and zip code. MINORS AND CHILDREN’S PRIVACY

 

STUDIONOW is offered and made available only to users who have attained the age of majority. If you are a minor you must discontinue use of this website immediately. If your use of STUDIONOW is prohibited or restricted in any way by the laws, regulations or other governmental requirements of the jurisdiction in which you live or reside, or if, for any reason and at any time, you do not agree with all of the terms and conditions of our Terms of Use, please discontinue using the STUDIONOW website and service immediately. By using or attempting to use the STUDIONOW website and service, you certify that you have attained the age of majority and meet all other eligibility requirements for your use of the STUDIONOW website and service. In the event that STUDIONOW or its Affiliates unknowingly send an e-mail or other message to a minor who has registered with the STUDIONOW website and service in violation of the STUDIONOW Agreement, the minor or the minor’s parent or legal guardian may unsubscribe (opt-out) from receiving future e-mails or text messages using the opt-out (e.g., unsubscribe) mechanism contained in the e-mail or message.

 

Parents (including legal guardians) of minors registered on the STUDIONOW in violation of the Terms of Use may terminate their child’s registration. Parents, use the Contact Page and provide us with your child’s User ID. Alternatively, a parent must provide verifiable identification of their parental status.

 

STUDIONOW will not allow direct access to a user’s registration and Personal Information by any person without the user’s User ID (Please see above for how to change your preferences or the information associated with your account). If a parent does not have his or her child’s User ID, the parent will be required to Contact the Privacy Administrator and include the parent’s name, address, telephone and e-mail address, in addition to the child’s name and e-mail address associated with the child’s User ID registered on the STUDIONOW website and service, plus the child’s date of birth. STUDIONOW will send a confirming e-mail to the parent via the e-mail address provided to verify that the parent wishes to terminate his or her child’s registration. The parent must then confirm by sending a reply e-mail to the designated return address. STUDIONOW will then terminate the child’s account but will notify the child of the termination request via e-mail and will identify the name, address and e-mail address of the person making the request. INTERNATIONAL USERS The STUDIONOW website and service is designed and targeted to United States (“U.S.”) audiences and is governed by and operated in accordance with the laws of “U.S.” STUDIONOW makes no representation that the STUDIONOW website and service is operated in accordance with the laws or regulations or is governed by other nations. If you are located in the European Union or elsewhere outside of the U.S. and you use the STUDIONOW website and service, you do so at your own risk and initiative. You are solely responsible for compliance with all of the laws and regulations that apply to you. Please be aware that any Personal Information you provide to us or STUDIONOW obtains as a result of your use of the STUDIONOW website and service, will be transferred to the U.S and subject to U.S. law. By using the STUDIONOW website and service, participating in any STUDIONOW activities and/or providing us with your Personal Information, you consent to the transfer and processing of Personal Information to the U.S. and in other countries that may not have an equivalent level of protection or a level of data protection considered adequate in the European Union or European Economic Area. INFORMATION COLLECTED

 

When STUDIONOW uses the term “Personal Information” STUDIONOW means information such as your first/middle initial or name and last name, street address, town or city, state, zip code, telephone number, instant-messenger nickname, blog or other personal website URL, date of birth, e-mail address and any other information that would allow someone to identify you or contact you. Personal Information also includes information about your personal preferences, survey responses and your transactions or relationship with us if you have been a customer or you have provided this type of information to STUDIONOW or any of its Affiliates (as defined in our Terms of Use). When you register with the STUDIONOW website and service, you are required to provide us with your e-mail address, as well as additional Personal Information. Users of the STUDIONOW website and service are required to provide true, current, complete and accurate Personal Information when prompted. STUDIONOW will reject and/or delete any entry that STUDIONOW believes in good faith to be false, fraudulent, or inconsistent with this Privacy Policy. STUDIONOW will allow you to change the password portion of your User ID, as well as certain other Personal Information you have given us in order to keep your information current, but once you select a user name you will not be able to change that user name you have given us during registration and which is associated with your User ID. Among other things, this information helps STUDIONOW identify you as a registered user of STUDIONOW and those services, features and functions you have registered or are otherwise authorized to use (e.g., Communities, Posting). STUDIONOW collects Personal Information about you when you visit the STUDIONOW website and service. STUDIONOW may also collect information you input when you register to use any services, features or functions of the STUDIONOW website and service, STUDIONOW may collect information when you participate in promotions, or in the course of any other exchanges of information, transactions and activities you undertake on our site. Cookies and Similar Technology: STUDIONOW use ‘cookie’ technology to collect data regarding your visits to the STUDIONOW website and service. HOW STUDIONOW USES YOUR INFORMATION

 

STUDIONOW may use the information STUDIONOW obtains from you, including Personal Information, to tailor your experience on the STUDIONOW website and service, and to display Content STUDIONOW thinks may be of interest to you. * If, in its sole discretion, STUDIONOW believes such disclosure to be necessary or appropriate to investigate or resolve possible problems or inquiries, to protect its business and assets, to defend its interests and/or to comply with its legal and regulatory obligations; or

 

* In the event of a bankruptcy, merger, acquisition, transfer of control, joint venture or other business combination involving STUDIONOW, or its Affiliates. As a registered user of the STUDIONOW website and service, from time to time, STUDIONOW may also provide you with certain options to opt-in to subscribe to e-mail newsletters and other periodic information. You will also have the right to opt-out or change your preferences at any time by logging in with your User ID and changing the settings in your account or you can opt-out or unsubscribe to particular e-mail communications by responding to that e-mail and using the ‘unsubscribe’ or opt-out procedure included in that communication. If you are a registered user, you acknowledge, understand and agree that you are giving STUDIONOW your consent to track your activities, your use of the STUDIONOW website and service and the functions and features, and agree to this Privacy Policy and its Agreement with you. PUBLIC INFORMATION Use of web sharing features including Communities: If you use any of the web sharing or Communities’ features and functions made available on or through the STUDIONOW website and service, please remember that any information disclosed in these venues is automatically made public. You should exercise caution when disclosing any Personal Information in a web sharing feature or in the Communities, as you do not know who will access and use your Personal Information or for what purposes. STUDIONOW is in no way responsible for the accuracy, use, or misuse of any information that you disclose or receive through these venues and you should assume that any disclosure you do make in these venues will be available publicly, even without your knowledge or authorization.

 

YOUR RESPONSIBILITY

 

It is your responsibility to give STUDIONOW current, complete, truthful and accurate information and to keep the Personal Information that you provide to us up to date. STUDIONOW is not responsible for any problems or liability that may arise if you do not give us accurate, truthful or complete information or you fail to update the information you give us.

 

You are solely responsible for maintaining the strict confidentiality of your user name and password . You are solely responsible for any charges, costs, expenses, damages, liabilities and losses STUDIONOW may incur as a result of your failure to do so. You are solely responsible and liable for your activity, behavior, use and conduct on the STUDIONOW website. You are solely responsible for any use of the website or any other activity or conduct in connection with the STUDIONOW website and service, by any others who use your user name or password, unless and until you notify us that your user name or password may have been compromised, misappropriated or improperly taken, or used by another party.

 

OPTIONS REGARDING CONTESTS, SWEEPSTAKES AND PROMOTIONAL OFFERS

Registration may not be required to enter Promotions such as contests and sweepstakes on the STUDIONOW website. These may have a separate registration or entry process and may require your submission of Personal Information such as your first and last name, street address, city, state and zip code, e-mail address, telephone number and date of birth. The entry page and/or Rules will provide the specific requirements for the Promotion involved. You may also have the opportunity to opt-in to special offers from its Advertisers in connection with many of these types of Promotions.

 

Opt Out Procedures.

 

STUDIONOW or its Affiliates may contact STUDIONOW registered users or others that have registered for or participated in various STUDIONOW Promotions, transactions or events, or send offers for the purchase of goods and/or services that may of interest to users. You may opt out of receiving marketing and promotional e-mails from us at any time by logging into the STUDIONOW website as a registered user with your User ID and editing the preferences and selections available to you and the information associated with your account. You can also use the opt-out mechanism that is contained in the e-mails STUDIONOW or its Affiliates send you. However, STUDIONOW or its Affiliates may continue to contact you via e-mail for administrative or informational purposes, including follow-up messages regarding the administration of your registration, any services, features or functions you have enrolled or registered to use, any Promotions you have participated in or have entered, goods or services you have ordered or other transactions you have undertaken with the STUDIONOW website and service.

 

If you wish to review Personal Information collected for Promotions such as contests and sweepstakes, you may Contact the STUDIONOW website and service’s Privacy Administrator and be prepared to provide verification of your identity. Personal Information collected for certain Promotions, such as contests or sweepstakes entries are subject to corporate and regulatory recordkeeping requirements and will not be deleted upon the user’s request unless the entrant is a minor.

 

ADVERTISEMENTS AND THIRD PARTIES

 

The STUDIONOW website and service may contain advertisements, references and links to other websites and organizations. STUDIONOW may also use third parties to display or serve advertising on the STUDIONOW and its web-based newsletters or other communications which you may choose to receive. Often these third party Advertisers employ cookie and web bug technologies to measure advertising effectiveness. Different rules might apply to the collection, use or disclosure of your information by third parties in connection with their advertisements, promotions and other websites. The use of such technology by these third parties is not within our control. Even if STUDIONOW have a relationship with the third party, STUDIONOW do not control those sites or their policies and practices regarding your information. This Privacy Policy does not cover any use of Personal Information that an Advertiser or ad server may collect from you. STUDIONOW do not sell, rent, lease or disclose your Personal Information to unaffiliated entities or entities that are not its Advertisers, except in the limited circumstances listed below. When STUDIONOW plan to disclose your Personal Information to Advertisers, STUDIONOW ask you to opt-in to do so, in which case their use of your information is subject to the Advertisers’ own privacy policies. EMAIL AND POSTINGS STUDIONOW respect the privacy of the contents of users’ e-mail and Postings. However, STUDIONOW reserve the right to monitor, edit, and disclose your use of the STUDIONOW website and service, information pertaining to any e-mail or Posting or its contents to a third party, if STUDIONOW believe such action is required by law or is necessary to protect and defend its rights, to enforce this Privacy Policy or its Terms of Use, or to protect the interests of its users, Affiliates, Advertisers, suppliers, service providers and others.

 

CO-BRANDED SERVICES AND FEATURES

 

The STUDIONOW website also offers co-branded services and features, such as events and/or Promotions that STUDIONOW puts together with another company of its Affiliates (“Co-Branded Partner”). Such services and features may be hosted on the STUDIONOW website and/or on its Co-Branded Partner’s website. STUDIONOW may share your Personal Information with its Co-Branded Partner and your voluntary use of or participation in a co-branded service or feature means that you opt-in and give your affirmative consent to both STUDIONOW and its Co-Branded Partner to collect and use your Personal Information provided during the Registered User registration process and/or in connection with the specific co-branded feature or service for the fulfillment of the feature or service and for marketing or administrative purposes. If you wish to opt-out of a Co-Branded Partner’s future use of your Personal Information for marketing purposes, you will need to contact the Co-Branded Partner directly.

 

USER VIDEO UPLOAD

 

Registered users participating in its User Video Upload feature agree to have certain Personal Information posted on the STUDIONOW website and service and the Platforms (as defined in the STUDIONOW Video Submission Service Agreement) or, if such feature is offered in connection with a Co-Branded Partner, on its Co-Branded Partner’s website in connection with the display of the user’s video. Registered users that upload videos may also be required to submit additional Personal Information.

STUDIONOW reserves the right to deny access, use and registration privileges to any user, including, without limitation, a registered user of any services, features or functions of the STUDIONOW website and service, if STUDIONOW believes there is a question about the identity of the person trying to access any services, features or functions of the STUDIONOW website and service. If the burden or expense of providing access to your Personal Information is disproportionate to the risks to your privacy, or if the legitimate rights of others would be violated, STUDIONOW may decide not to provide access to such information. In such cases, STUDIONOW will provide to you an explanation of why access cannot be provided and a contact person for further inquiries. Your continued participation of the STUDIONOW website and service indicates your acceptance of this Privacy Policy and of the collection, use, disclosure, management and storage of your Personal Information as described below. STUDIONOW may, from time to time, transfer or merge any Personal Information collected off-line to our online databases or store off-line information in an electronic format. STUDIONOW may also combine Personal Information STUDIONOW collects online with information available from other sources, including information received from its Affiliates, marketing companies, or Advertisers (as defined in our Terms of Use). This Privacy Policy covers all such Personal Information and will remain in full force and effect as long as you are a user of the STUDIONOW website and service, even if your use of or participation in any particular service, feature, function or promotional activity terminates, expires, ceases, is suspended or deactivated for any reason.
